फर्जी वोट घोटाले में पूर्व खेल राज्यमंत्री को हाई कोर्ट से जमानत की राहत: शिकायतकर्ता हाई कोर्ट के फैंसले को सुप्रीम कोर्ट में चुनौती देंगे .

चंडीगढ़ फर्जी वोट मामले में हरियाणा के पूर्व खेल एवं युवा कल्याण मामलों के राज्यमंत्री सुखबीर कटारिया को हाई कोर्ट के जज शेखर धवन ने अग्रिम जमानत की राहत दी है। इससे पहले गुड़गांव के अतिरिक्त जिला एवं सत्र न्यायधीश की कोर्ट ने पुलिस जांच में सहयोग न देने पर पूर्व राज्यमंत्री की अग्रिम जमानत रद्द कर दी थी, जिसको सुखबीर कटारिया ने हाईकोर्ट में चुनौती दी थी । सरकार की तरफ से पेश हुए अधिवक्ता की इस दलील को कोर्ट ने खारिज कर दिया कि अभी तक एक भी दस्तावेज़ की बरामदगी पूर्व मंत्री से नहीं हो पाई हैं।

दूसरी ओर शिकायतकर्ता ओम प्रकाश कटारिया के वकील प्रदीप रापडिया ने कोर्ट के आदेश से असहमती जताते हुए कहा कि वो हाई कोर्ट के फैंसले को सुप्रीम कोर्ट में चुनौती देंगे । हाई कोर्ट के फैंसले पर दुख जताते हुए शिकायतकर्ता के वकील ने कहा की एकओ ओर हाई कोर्ट छोटे-छोटे मामलों जैसे बैंक कि ट्रेक्टर का लोन लोन ना देने पर, जमीनी विवाद, दहेज़ आदि के मामलों में भी लोगों को कई-कई महीने जेल में बिताने के बाद भी हाई कोर्ट से जमानत नहीं मिलती; लेकिन इस एक षड्यंत्र के तहत हजारों फर्जी वोटों की मदद से चुनाव जीतकर लोकतंत्र लोकतंत्र के अपहरण के दोषी को घर बैठे जमानत अग्रिम जमानत मिल जाती है और पुलिस असहाय नज़र आती है । ऐसे में हाई कोर्ट  के आदेश से समाज में सन्देश जाता है की इस देश में दो तरह के कानून हैं, एक अमीरों और प्रभावशाली लोगों के लिए और दुसरा आम आदमी के लिए ।

शिकायतकर्ता के वकील ने कोर्ट में दलील दी कि पूर्व खेल मंत्री की जमानत याचिका का विरोध करते हुए कहा कि कि अधिकांश वोटर फार्म पूर्व राज्यमंत्री ने अपनी हैंड राइटिंग में भरे हैं, जबकि कुछ दस्तावेजों पर उनके हस्ताक्षर भी हैं और कोर्ट के आदेशों के बावजूद आरोपी अपने प्रभाव का प्रयोग करते हुए पुलिस जाँच में सहयोग नहीं कर रहा है । ऐसे में आरोपी को जमानत देने से पुलिस जांच प्रभावित होगी और गवाहों पर भी दबाव बनाया जाएगा ।

गुड़गांव गांव निवासी और मतदाता जागरुक मंच के अध्यक्ष ओम प्रकाश कटारिया पुलिस को दी शिकायत में राज्यमंत्री सुखबीर कटारिया व उसके सहयोगियों पर फर्जी दस्तावेज तैयार कर फर्जी वोट बनवाने का आरोप लगाया था। आरोप है कि आरोपी पूर्व मंत्री ने षड्यंत्र के तहत अन्य लोगों से मिलकर हाउस टैक्स की फर्जी रसीद तैयार की, फर्जी राशन कार्ड, फर्जी बिजली के बिल बनाकर वोट कार्ड बनवाए। इतना ही नहीं एक-एक व्यक्ति के कई कई फर्जी वोट भी बनवाए गए। इन वोटों का इस्तेमाल राज्यमंत्री ने 2009 में हुए विधानसभा चुनावों में अपने पक्ष में किया और जीत हासिल भी की। बाद में प्रदेश सरकार ने उन्हें राज्यमंत्री का ओहदा भी दे दिया। सभी मामलों की जांच एसआईटी कर रही है।

DESPITE ALLEGATIONS OF THREAT TO THE COMPLAINANT AND WITNESSES: HC GRANTS ANTICIPATORY TO FORMER HARYANA MINISTER. COMPLAINANT WILL APPROACH SUPREME COURT.

CHANDIGARH: 20.10.2015 On Tuesday, Justice Shekhar Dhawan of Punjab & Haryana High Court confirmed the earlier interim bail granted to the former Haryana Sports Minister Sukhbir Kataria in the fake voter scam case. Though, the state counsel as well as Mr. Pardeep Rapria; the counsel for the complainant opposed the bail by that the accused was evasive during interrogation and not cooperating with probe agencies, due to which not even a single recovery has been effected from the former minister. He is misusing liberty of anticipatory bail and is influencing the witnesses by giving them certain directions. Mr. Om Parkash Kataria,the complainant heading crusade against the former Haryana Minister, Sukhbir Kataria, has decided to approach the Supreme Court seeking cancellation of anticipatory bail granted to the accused.

The complainant’s counsel Pardeep Rapria  alleged in the court that Mr. Kataria was “dictating what needs to be said to the witnesses” in the case and claimed there was “overwhelming evidence” to show that he had misused the bail conditions. The complainant’s counsel also apprised the High Court that the accused minister had offered Rs. 10 crore to the complainant for not pursue the cases.

Justice Shekhar Dhawan also ignored the argument of the State that the accused minister had created more than 31000 fake votes; and won the election on the basis of these fake votes. The HC also declined to go into the criminal antecedents of the accused minister involving the offences of gang rape, theft, insult of worshiping place, causing injury with dangerous weapons etc.

          At present, more than 28 FIRs have been registered against the former minister and in more than 16 cases the Gurgaon court has summoned him to face the trail, on the allegations of involvement in the massive fake vote scam. More than 300 complaints of similar nature are also under consideration of the SIT formed to unearth the scam.
