Today, I had privilege to hear the
views of the international and national figures on ‘INTERNATIONAL CONFERENCE ON TRANSPARENCY
& ACCOUNTABILITY IN JUSTICE ADMINISTRATION SYSTEM: CHALLENGES &
SOLUTION’ The Chattani or Mix-Fruit Chat of the whole day deliberations is: Judiciary
is the last hope of people, so it must be independent and for the independent
Judiciary the ‘Independent Minds’ are required. The Judges should be the men of
integrity and propriety. Corruption is not only in terms of money; it has
different shades...Discovery of the Fundamental Right ‘Right to Know’ was by Supreme
Court, but now this same court is fed-up with its own discovery. All the three
organs of State are agents of people. Act and conduct of Lawyers etc. etc. etc.
Sounds very nice, but when we enter into court room; all the aforesaid
discussions & principles vanishes into air and the competent lawyers, the
so called ‘Officers of the Court’ fight for their survival in front of the
corrupt and incompetent judges and the Senior Advocate, siblings of Judges/Bureaucrats/Politicians
have last laugh in the court. And, the competent and knowledgable lawyers are
the worst victim, because if an incompetent lawyer is spontaneous humble & diplomat
towards judges, because he knows that he is ignorant of law and therefore he
has to be at the mercy of judge. But the real problem of the knowledgeable and
competent lawyers; because they try to stand on the legs of knowledge and
talent; which is rarely appreciated.
After hearing the nice talks of the Conference
the very vivid pictures of the repeated injustice, corruption, hollow
arrogance, incompetency etc. of the judges floats before eyes. How can I forget
the personal experience of an honour killing of a girl during the pendency of
habeas corrupts petition before the High Court and Supreme Court, only because
of the casual and callous approach of a judge? How can I forget the cases which
were admitted (means which will come-up for hearing after 15-20 years) due to
the personal vengeance of a judge towards a lawyer, despite fully knowing well
that the client, due to 70+ age will be no more alive to see the verdict? How
can I forget the last laugh of the incompetent lawyers getting undue relief in
cases only because of their so called humbleness or connections? How can I
forget the insecurity and jealous of judges with the budding intelligent
lawyers? How can I forget the misery of a jail inmate who couldn’t come out of
jail only because his family members refused to pay the hefty amount of Rs. 5000/-, in
contrast to the legal fee of Rs. 100/-, to the clerk of a lawyer for getting
order and the Bail order was not provided; due to the nexus between the Govt.
Staff & Lawyers’ clerk?
With
little bit experience I come to conclusion that the courts have become only the
source of the livelihood of the judges, lawyers and subordinate staff,, by and large, surviving on corruption, where justice is only coincidental.
