HC ISSUED NOTICE TO TWO HARYANA IAS OFFICERS AND TWO BDPOs FOR CONTEMPT OF COURT

 CHANDIGARH 19.11.2015: Justice Rakesh Jain of the Chandigarh High Court has issued Contempt of Court Notice to Chander Shekhar Khare, Deputy Commissioner, Hisar, M.L. Kaushik,the former Deputy Commissioner, Hisar, presently posted as: Director Secondary Education Haryana, Panchkula. Sombir Kadiyan, BDPO,  Narnaund, District – Hisar, Rajender Panwar, the former BDPO, Narnaund, presently posted as BDPO, Barwala, District – Hisar (Haryana). These officers have been directed to explain to court by 28.01.2016 as to why they should not be punished with imprisonment of 6 (six) months with maximum fine of Rs. 2,000/- for committing the contempt of court by not implementing the directions issued by the division bench of the High Court on 26.8.2013 in writ petition filed by the residents of village Majara of Hisar District, seeking eviction of about 200 (two hundred) encroachers of the panchayat land.
            The order came after hearing Mr. Pardeep Rapria, Advocate for the Petitioner; a more than 85 years old retired head master Beer Singh, resident of village Majara, who apprised the court that despite the rigorous follow-up of the matter by a senior citizens at an advance stage of life, up to High Court, for getting evicted the encroachers of the panchayat land reserved for common benefit of villagers, the officers have turned deaf ear and have defied the directions of the High Court. As a matter of record, the High Court in the year 2013, after hearing the plea of villagers had directed the Deputy Commissioner, Hisar and BDPO, Narnaund to evict more than 200 unauthorized encroachers; who had usurped the panchayat land reserved for common benefits of village community. Subsequent the High Court directions the petitioner; despite his advanced old age, gave numerous representations at CM Window, the office of DC Hisar and Director Panchayat,for getting implemented the High Court directions, but all in vain. Left with no option the petitioner had to knock the doors of the High Court.
