Subject: Invasions of the privacy of a child; without permission of parents
and despite strong objection.

Sir/Madam,
1.
My daughter Tamanna Singh, Roll No. 232 studying in class 1st
-H, in OSDAV Public School, Kaithal
2.
That the OSDAV, School, Kaithal, had been constantly
insisting on the AADHAAR CARD of my daughter, through series of telephonic
calls and messages. Therefore, on 28/10/2015 I had to write to School in my
daughter’s school diary, which reads:
“Please refer to the telephonic message
in reference to the AADHAR CARD of my ward Tamanaa Singh. In this regard, this is to inform you that we don’t
have card and I don’t wish to have the same for my ward, till the final
verdict of Supreme Court of India, which
is pending adjudication on validity of a card.”

That yesterday, i.e. 04.02.2016, my wife received a
telephonic call on her mobile no. from my daughter’s class teacher; saying ‘as
per the strict instructions of the Suman Nijhawan, Principal of the School, the
date of birth certificate and ration card is required immediately for school
record on online updating of date.’ Accordingly, my wife provided the date of
birth proof and ration card.

That today, i.e.,
05.02.2016, I am shocked to listen from my daughter that her eye retina and
fingers/palm were scanned for creating AADHAR CARD. The school has violated the
precious privacy of my daughter, without the consent of parents, rather despite
express denial by me.

That in CWP No.9889 of 2015,
date of decision:29.05.2015, in which Director, School Education,
Haryana was one of the parties in writ petition before the High Court of Punjab
and Haryana, relating the demand of AADHAAR CARD from students, and on the
instructions of the Director, School Education, Mr.B.R. Mahajan, Advocate
General, Haryana, made statement in the court that the getting of ‘Aadhaar
Card’ is not mandatory’ And, co-incidently, I was the counsel for Petitioner in
the aforesaid matter. The true copy of the High Court Order is annexed
herewith.

That the Hon’ble Supreme Court of India, through series of
interim orders, had directed all the states not to force any one for AADHAAR
CARD. The true copy of the Supreme Court is annexed herewith.

That I just telephonically spoke to Mrs. Suman Nijhawan,
Principal, OSDAV Public School, Kaithal, at 1817 hours, (Mobile No. +919416035350)
and expressed my disappointment and concern for the violation of the privacy of
my daughter. However, I am given to understand by Mrs. Nijhawan that she has
been forced by the Deputy Commissioner, Kaithal and other concerned senior
officers, by giving written instructions, to register each and every student
for AADHAR CARD. She has asked me register my protest on the e-mail ID of the
School, i.e., dav.kaithal@gmail.com

That the the primary role and responsibility of parents is to protect
the privacy of children. This parental responsibility has been recognized as a
constitutional parental right—a component of the
parental right to privacy. And, my daughter’s privacy has been compromised
despite of my strong disapproval and written objection against the enrolment of
my daughter for AADHAAR CARD.
With
a view to avoid legal recourse, through this E-mail I write to all the
concerned officers to immediately delete/erase the personal data of my daughter
from all computer/computer resources and serves, failing which I will be constrained
to initiate criminal as well civil legal proceeding against the concerned
officers. If
I am not given positive response by tomorrow evening, I will have no option
except initiate legal proceeding against the concerned officials, including
Principal, Deputy Commissioner, Kaithal, DEO, Kaithal etc. for violating the
fundamental right, i.e., right to privacy of my daughter without consent of
parents.
