GURUGRAM AMMUNITION DEPOT: Restricted Zone in Gurgaon is 900 Mtrs. Collector to decide compensation to residents

Demolition threat is looming large over 6,000 houses in the radius of 300 metres surrounding air force ammunition depot in Gurugram. On Wednesday, the Add. Solicitor General appearing for the Central Govt. cleared the stand of the Central Govt. to the effect: "As on date the area of restriction on the use and enjoyment of property within the vicinity of ammunition depot, Gurgaon is: 900 mtrs. However, after removal of construction within the 300 meters the notification will be issued by the Ministry of Defense for restricted zone of 300 meters"  On Tuesday the HC had asked the Additional Solicitor General of India to be present at 10:00 AM, with instructions from the Cabinet Secretary on the extent of restrictions around the Gurugram ammunition depot. The air force ammunition depot is spread over 802 acres in sector 17 and is considered as highly sensitive zone having large number of bunkers and safe house for ammunition.
      Pardeep Rapria, the Advocate for the residents residing within the zone of 300 meters and also 900 meters argued that the constructions can not be removed without awarding compensation and rehabilitation of the residents. As per earlier survey report, there are 6,000 houses spread over 634 acres land falling under 300 metres from the wall of the ammunition depot. It was also argued on behalf of the residents that the situation under the Works of Defense Act is worse than the acquisition of land, because, though a person is always an owner of the land, but he can not grow even a plant on his own land. 
         In the course of hearing, the Counsel appearing for the Haryana Govt. apprised the court that more than 4000 objections have been received by the Collector and the tender has been called from the agencies for surveying the area for determining the compensation amount. Upon this, the HC directed the Collector, Gurgaon, to expedite the process of determining compensation to the residents and file Affidavit about the steps taken in this regard. The issue of rehabilitation will be considered in the ensuing hearing of matter. When the HC expressed concern over the threat to the lives of people residing within the restricted zone Mr. Pardeep Rapria argued that the present dangerous situation is actuated by the 'legalized complicity of the State and its instrumentality' as  there are several unauthorised HUDA sectors such as 17, 18, 16 14, many government offices and some areas of Maruti plant falling under 300 metres.
            The matter has been posted for hearing on 14th August, 2018.
